THIS TERMS OF USE AGREEMENT (the “Agreement”) constitutes a legally binding agreement by and between Brandible Digital Ltd, a company legally registered in the United Kingdom (“Brandible Digital,” “we,” “us,” or “our”), and the client, whether personally or on behalf of an entity (“Client,” “you,” or “your”), regarding your access to and use of https://www.brandibledigital.com (the “Website”) and any related media channels, mobile sites, or applications.
By accessing or using the Website, the Client agrees to be bound by all terms, conditions, obligations, and notices contained within this Agreement. If the Client does not agree, they are expressly prohibited from using the Website and must discontinue use immediately. Any outstanding payment obligations for services rendered shall remain in full force.
1. Intellectual Property Rights
Unless otherwise stated, the Website and all source code, databases, software, designs, audio, video, text, photographs, graphics, and all trademarks, service marks, and logos (“Content” and “Marks”) are owned and controlled by Brandible Digital and protected under applicable UK, EU, and international intellectual property laws.
The Content and Marks are provided “as-is” for personal, non-commercial use. No part of the Website or Content may be copied, reproduced, republished, modified, uploaded, or commercially exploited without Brandible Digital’s prior written consent.
All rights not expressly granted are reserved.
2. Ownership of Materials
All design work, deliverables, and original source files created for the Client (“Projects”) become the exclusive property of the Client upon final payment. Should any law or default assignment transfer rights to Brandible Digital, such rights are automatically and irrevocably assigned back to the Client.
The Client warrants that any materials provided to Brandible Digital do not infringe on any third-party rights, including copyrights, trademarks, and rights of publicity.
Brandible Digital reserves the right to display completed Projects for portfolio and marketing purposes unless otherwise agreed (See Section 19).
3. Third-Party Fonts
If a Project includes fonts requiring a commercial license (“Third-Party Fonts”), Brandible Digital will notify the Client and provide purchase information. It is solely the Client’s responsibility to secure the correct licenses for legal reproduction, distribution, or display. Brandible Digital is not liable for misuse of unlicensed fonts by the Client.
